Legal Question in Family Law in Maryland

Residency/address requirement

What are the requirements for a Defendant to list his address on a divorce pleading?

If he has moved out of the marital home, can he still use the marital home's address as the address in the court filings? Does he have to disclose where he is actually living?

Re: Residency/address requirement

An original pleading is supposed to contain the addresses of both parties as per the Maryland Rules of Civil Procedure. However, I have often seen a party use his or her attorney's address if that person does not want to advertise his whereabouts. Where a person really resides can be inquired into in the discovery process.

An attorney's address can be used and you may want to consider this if there are issues involved with disclosing your address.

The property will require disclosure at some point unless it is not marital property.
