If you are actually divorced, as opposed to just separated, then the distribution of your retirement benefits should have been taken care of at the time of the divorce, or possibly within 90 days thereafter, unless you agreed to a longer delay. If none of this happened, it's too late for your ex to try and claim part of your benefits. You should consult with an experienced family law attorney if you've been served with court papers regarding this.
