Grandparents' rights to visit with their grandchildren are not dependent on the marital status of the parents. If the parents are denying them visitation on a voluntary basis, they can file a court petition asking the court to award them visitation. The court will do so if it feels that that would be in the best interest of the grandchildren, but be aware that the wishes of the parents would be given great consideration.
