am I screwed?

the father of my child was incarcerated for non payment os child support on 9/27/2004 and a money judgment was entered for the money he owed ($5,790.37) the ncp put up money to get out and has not paid a dime since then. My husband adopted the child a year later but the judgment is still outstanding and other monies are owed on the arrearage that accumulated after that. The ncp has agreed to monthly payments to pay off money judgment but has not paid a dime. I know the state has laws about criminal prosecution for refusing to pay. Am i still able to file those charges since he refuses to pay or am I screwed? He owes over $6,000 in total and feel he should not be able to get away with not paying and feel he should be prosecuted. Do I do this at the commissioners office? Thank you

You may have already received them, but if not you should check with the court where he was incarcerated to see if you can forfeit the bond he posted to get out of jail and apply it to the arrearage. If the ncp is employed, you can garnishee his paycheck. You can also file another show cause order seeking contempt for nonpayment, which would ultimately re-incarcerate him.
