Legal Question in Family Law in Maryland

Separation Papers Still Legal?

I separated back in '04 in Virginia, we tried to reconcile, but it has not worked out and I want out of this marriage. Are these papers still good in Maryland?

He was paying $500/month for child support, will this still hold up till our son is 18?

Re: Separation Papers Still Legal?

Your recitation of facts is somewhat vague. I assume you had a separation agreement calling for your husband to pay child support, but after you got back together he presumably stopped paying. You're now living in MD. If you are planning to separate again, you should petition the court here for custody and child support. The amount of support will be determined by the MD child support law, which has a schedule to determine the amount of child support that the noncustodial parent must pay, based upon the respective income of the parents. Your agreement may no longer be enforceable since you reconciled.
