Legal Question in Family Law in Maryland

Seperated, seeking child support answers

My girlfriend has been seperated from her husband for 2 years, he pays no child support. Almost a year ago her and I moved in with one another and now reside together. She will be seeking child support in the very near future. Does it matter that we live together and would the courts take into account both of our salaries together in order to fix the support amount? What impact, if any, does the fact that we live together have on her ability to recieve child support. Her husband does not know that we live together. The three children are with us and he will not seek custody.

Re: Seperated, seeking child support answers

Your living together does not affect the father's obligation to support his children. Since the formula used by MD to determine the proper amount of support only considers the joint income of the parents, your income should not be a factor.
