Legal Question in Family Law in Maryland
seperation
I found out that my wife is seeking to have me evicted from our house for no other reason
than she wants a seperation. At present, I have too many expenses to look for housing else where. Secondly, she has another house in her name only. Can she legally have me evicted from our house ? Can the law require her to move instead since she has another house ?
Thanks,
Greg

Re: seperation
If a divorce is pending then how each house is titled is important as to whether she can have you evicted. But in order to have a court ordered eviction, you must hold no title and have a lease on the property; otherwise, she cannot divest you of marital property without a monetary award through a divorce or a property separation agreement for the court to grant. You may otherwise hold an equitable interest in property that can be asserted in court. Contact a lawyer to persue a separation agreement or file for a consent order. If you face an eviction proceding ensure that the property owner is not acting of self help but under court approval.
