Legal Question in Family Law in Maryland

i want to serve my husband the device papers but we been saparted for a year but he still live at home with me. went as far as giving him the basment room i live in the state of maryland please help my question is can i do so

As long as you have not reconciled with your husband (by having sex with him, by sharing a bed with him, etc.), then it should not matter that you are technically living under the same roof. The standard is whether you are living "separate and apart." The basement is separate and apart.
