Serving divorce papers through certified mail

I sent my divorce papers to my spouse through certified mail, but the receptionist signed for the package instead of him. Can I still use the green card as proof that he was served or do I have to resend them so his signature is on the card. Thank you.

You cannot serve the papers on him, they must be served by an adult who is not a party to the case. In addition, if certified mail is used as opposed to personal service, the papers must be sent certified, restricted delivery and signed for by your spouse.

You can't legally serve him through someone else where he works, but if he files an answer then it doesn't matter. If you have to serve him again, do it where he lives. If someone else living there signs for the papers, you've complied with the rules. But first I suggest you try and find out if he's going to answer the complaint so you don't have to start over.
