share of future revenue

My Husband was contracted to design medical equipment. He was paid for this service and this income is not an issue. The investors have a contract to buy more of the instruments he has already designed. My husband and I are in the process of getting a divorce. My question is can I ask for a share of the future revenue that my husband may see from selling this equipment (this includes the sale of what is already in the contract and also for future contracts).

As a general rule, you're entitled to share income earned during the marriage. This would rule out your entitlement to income received by your husband after the divorce. However, if you can demonstrate that you made sacrifices, such as giving up a potential career to work while he was designing and marketing this equipment, you may be able to convince a court that you should benefit from his future income through alimony. The typical case is the spouse who works to put her spouse through med/law school only to get divorced just as he's about to realize the benefits of his schooling.
