shared custody

My exhusband and I share legal custody of our two children,I have physical custody. I want to move to NC.

Do I need to get court permission?

He is supposed to get them every other weekend, but hasn't tried to see them in more than 8 months.

This depends on the terms of your joint legal custody arrangement, as would be set forth either in a separation agreement or a court order. If there are provisions that restrict how far the children can be living from their father, then you would have to work something out with the father, or failing that, petition the court for a modification. If he has not made recent efforts at visitation, he probably won't fight you over it, but it would be wise to contact him (letter or email) and explain why you want or need to move and that you aren't trying to take the children away from him and will cooperate if he wants to arrange weekend visits). I assume he's paying child support, and you don't want to jeopardize that by doing it surreptitiously.
