Sharing Room with Father

My ex-husband and I share custody of our 2 year old daughter. He just moved into his own place and rented a one bedroom apt. He says he put a bed in there for her and they are sharing a room. I am very concered about this. He has a girlfriend and I think she stays over. My question is Is it legal for him to share a room with our daughter?

There is no specific law that prohibits this, but if you believe that it is detrimental to your daughter's interest to be in this living arrangement, you can file a court petition and ask for sole custody. The court will investigate the respective living arrangements offered by each parent and determine what is in the best interest of the child. Your ex would still be entitled to visitation if you are awarded sole custody, but the court could require him to change the current sleeping arrangement before allowing overnight visitation.
