Single mother passed away, 2 year old used to live with mother. What are the steps that the biological father needs to take?

I am assuming from your question that the child is not residing with the father. If the child is now with the father, then he doesn't have to do anything unless someone is contesting custody. If there is a dispute, he would need to file a complaint for custody in the Circuit Court and name whoever has the child as the defendant, indicating that the biological mother is deceased.
