Legal Question in Family Law in Maryland

single, unemployed mother- child support?

I am a single unemployed mother of a six month old. My son's father has only seen him 3 times and held him just once. He has given me money three times, totalling $1200. He works for himself, and may not report his earnings to the IRS. Also, a large amount of his money may be gotten illegally. He maintains that he will give me money when I need it, and whenever he can, but I'm not sure that I can trust him. My question is, what is my best course of action to ensure that my child is financially provided for by his father?

Re: single, unemployed mother- child support?

Your best course of action is to file a paternity action in the court of the county in which you reside. Your petition asks the court to declare him to be the father and to order him to pay child support on a regular monthly basis in accordance with the MD child support guidelines. He will have to supply income information in order to compute the correct amount of support. Since you have no income, I suggest you seek the assistance of the child support enforcement office in your county in this endeavor. The other option is if he's willing to admit paternity and submit himself to the court's jurisdiction so that all of this can be put into place expeditiously. But I'm guessing that's not likely.
