Legal Question in Family Law in Maryland

Speeding Up a Divorce

I recently separated from my husband. We have a legal separatin document. I have since found out he's been having an affair and have numerous vonage voicemail messages proving such. I don't expect it will matter financially, but can I speed up the process? Right now you have to be separated one year before a divorce can be obtained.

Re: Speeding Up a Divorce

If you believe you can prove adultery in court, which means proving that your spouse had the disposition as well as the opportunity to commit adultery, there is no waiting period before you can file for divorce. Otherwise, you will have to wait at least a year before the divorce can be filed. However, as with any legal matter, it is more complicated then just having a voicemail from his girlfriend. Even if you decide not to pursue adultery, keep the voicemails. They can be used in other ways. If you would like to discuss this further, please feel free to call me.
