In the state of Maryland when your spose dies and there is no will who is the legal benificiary?

It gets a little bit complicated, and depends on whether there are surviving children and parents of the decedent. If there are none, the surviving spouse generally takes the entire estate. If there are surviving children or parents, the surviving spouse generally gets the first $15,000 plus half of the remainder of the estate. If the surviving children are minors, then the $15,000 thing goes away and it's simply half of the estate.
