There is information you left out. Did the spouse ever pay the mortgage? Why was payment stopped? What is going on with the relationship? Is either spouse thinking about divorce (limited or absolute)?

Yes, although if the mortgage note is in the name of both parties, the spouse paying the mortgage has the right to assert a claim for contribution.
