If my spouse signs a non formal agreement before we seperate, can that be bindin

I will be moving away during our seperation. I am planning on leaving all assets in exchange for him taking custody of your minor child as well as any debt we have incurred since the marriage. Can I type something up and have it simply notarized and signed and it be legal?

Your question interposes upon many matters that have occurred during your divorce and custody of a minor child.

My advice is that you speak with an attorney before proceeding further. You should not rely upon internet question and answers for this matter.

Divorce and custody is an area of law that requires an attorney who is capable of understanding your situation and needs. If you are asking whether I would advise that you sign such

an agreement without knowing of your case, my answer is no...DO NOT SIGN IT. However, upon reviewing your case it may be advantageous for you to sign this agreement.

Properly drafted and in support of Maryland law, such an agreement, upon signing and notarization of the parties, is legally effective. Whether you should sign and whether such agreement is to your benefit is another matter.
