Which State to File Custody Issues

I was Divorced in Maryland in 1998, 3 children with 50/50 shared custody. In 2000 I moved to Missouri, fighting for change of custody of 2 of my 3 children. I won custody. My oldest fought and decided he wanted to stay in Maryland. In April 2001, an agreement was made that my ex-husband will have physical custody of my son and I will have physical custody of my daughter. All expenses and transportation and child support issues were agreed upon. In the summer, 2001, while my daughter was visiting for her 5 weeks visit, my ex-husband decided to file abuse and change of custody. No abuse has been found by social services in either state. My question, since my daughter is a resident now of Missouri and has been since this agreement in April 2001, is there any way that I can force all litigations to occur in Missouri instead of Maryland. Does this have to continue in Maryland, having me commute back and forth to fight charges. When social services are involved, doesn't it make more sense to have it occur in Missouri since my daughter actually lives here?

You can file a motion in the Maryland court asking to have the case removed to Missouri because that is where all of the evidence and witnesses are. I suggest that you consult with a family law attorney in Missouri and ask that attorney to locate a Maryland attorney to file the necessary papers.
