Is there a statue of limitations?
My stbx was investigated by CPS for abuse allegations by our child. CPS and the detective involved stated there was enough evidence to indicte him. But in the written letter it said charges have been indicated. Well, no charges were ever filed, but my stbx was ordered no contact for one year until child's counselor felt it was safe by the custody evaluator handling our case. Now we still haven't been to court to have this order put in writing because the court wanted our divorce handled at the same time!
My question is, can I come back after our divorce is final and pursue criminal charges against him? My child still wants nothing to do with him.

Generally, misdemeanor charges must be prosecuted within 1 year of the offense. If the offense involves sexual abuse, it must be brought within 3 years. Felony charges would have a longer limitations period, depending on the offense.
