Step-child Adoption

I recently moved from another state and I need to know the Adoption process for step-parents. The biological father is on the birth certificate and is incarcerated in the state I moved from.

Can my husband adopt my daughter without him knowing? I know that the biological father will put up a fight about this and I want her to be legally my husbands.

Please help. Thanks.

Re: Step-child Adoption

The father is entitled to notice and to participate in any proceedings seeking to terminate his parental rights. If he objects, you will have a difficult time succeeding.
