Supoena Served In Divorce Case
I was in an affair with a woman who later admitted to me that she was married. Now a year has passed since ending the affair and I have been served with a summons to appear in her divorce trial by her husband who is acusing her of adultery and charging me with being her paramour. Must I appear for this trial, and should I hire legal representation ? Can I make the other party pay my attorney fees ? I have'nt seen or spoken with this woman in over a year, and being in court with her and her husband present will be most awkward. Can't I give a deposition or sworn statement instead ? PLEASE HELP !!

You may be cited if you do not comply with the subpoena. I would need to know further details as to your involvement. Adultery is a criminal offense and punishable by a $10 fine. This may be something that you do not want reflected upon your record and may be addressed through counsel without the potential ramifications. Contact me for representation.

You must obey the subpoena, but try calling the attorney who issued it and see if a deposition is an acceptable alternative.
