Can you have a separation agreement without going through the courts as long as both parties agree?

Yes, you can enter into a separation agreement that covers all aspects of the separation. In fact, as a family law practitioner, I highly recommend this approach, because it resolves potential problems early and avoids time and expense when either party proceeds with the filing of a divorce. But it would be a serious mistake for you to try and do this without the aid of an experienced family law attorney, especially if there are children, real estate or retirement assets involved.
