Terms of State Divorces

I wasmarried in Hawaii, but am living in Maryland,

do you have to get divorced in Maryland. I am

moving to Phila. PA. and would like to get

divorced in Phila.., PA. Can I get divorced in

Phila.PA?

There is a residency requirement of six months in Pa. to file here. Although it is possible for your spouse to object to the filing here based upon it being inconvenient, you may file here initially.

You can file in PA when you meet the residency requirements and since I'm not licensed to practice in PA I am unsure of how long you must reside there before filing.

You could only file in MD prior to leaving MD. In otherwords, you can't move to PA and file in MD unless your wife lives in MD. If your wife does live in MD I would tell you that MD is where you should file because the court would then have what is known as personal jurisdiction over her to enforce its judgment on her for issues such as property distribution and spousal support, and if applicable, child custody and support.
