theft

my ex husband and i are in a custody battle over my 11 year old daughter. he told my daughter to bring her latest report card with her and that it had to be the original. He also told her that he would not believe her if she wrote down her grades. against my wishes, my daughter took her original report card to her father's house and he kept it without asking her or my permission. is this theft and should i bring it up in court?

I don't think it would be considered theft; more like intimidation of your daughter. You should ask your ex to send you a copy, and if he doesn't cooperate, ask the school admin to do so. He's entitled to know her grades, but if the school requires the card to be signed by a parent and returned, someone needs to take care of that.
