Legal Question in Family Law in Maryland

Total income of remarried custodial parent

Mother has custody of 2 minor children, boyfriend moves in 1 month after father moves out, mother marries boyfriend upon final divorce decree. Mother has own business (self-employed) reports earnings of between $50,000 to $60,000 per yr. New husband works, also pays alimony to his ex-wife.

Can the income of custodial mother's new husband be included for purposes of computing child support? If they file a joint return? If they file separate returns?

Re: Total income of remarried custodial parent

The mother's new husband's income is not considered when computing child support. Only the incomes of the parents are used to calculate the amount to be applied to the Maryland Child Support Guidelines.
