unpaid child support
I have an order for support for my child. The father will not pay what is ordered. He owes a lot of money and some of the arrears the judge gave me a money judgement. I was informed that I can go and press charges for criminal non support. I was wondering if I could file against him for the money judgement since he won't answer interrogatories etc for aid in execution. Thanks for any advise.

If the father has any assets you may be able to collect the amount of the judgment, plus ten percent per year in interest from the date of the judgment, plus attorney fees, and you can file a garnishment action to collect from his income or bank account. If he owns his home you can attach that. Usually if the parent ordered to pay child support is employed, child support (and child support arrears) is deducted from his pay by the employer and sent through the child support system to the custodial parent. If the father is unemployed and without assets, everything gets more difficult, but he can be required to look for a job and he can lose his driver's license until he begins to pay. If he refuses to answer interrogatories in aid of execution on a judgment, he may be in contempt of court and subject to some jail time.
