Legal Question in Family Law in Maryland
Verbal abuse
I live in MD. He lives in VA. I am t/victim of verbal abuse both infront & not infront of our child. Can I get a restraining order for this? Called a floozy, slut, told to shut up. Told if he is forced to take a paternity test & is found not to be t/father that he would make sure that I got my judgment, not by a court or God. I took this as physical harm to me. Also, that he will do whatever it takes to get our son if he is found not to be t/father. Been told that I am ''a real class act'' in a demeaning tone infront of children because I 4got my sons jacket on a visitation. Been told he was an animal lover & thats how he was able to stay with me so long.Though these are not physical threats to my body, I was very scared after the incident of a month ago in reference to me getting my judgment & doing what it takes, I took as a fear to my safety or that my son could be kidnapped.
1) Could I get a restr. order even though it was 1 mth ago especially since we have not gone to court for paternity yet? 2) Can I file it in MD though I have only lived here for 1 month, incident occured in Va & our court custody order is in Va?
We are to appear in Court in Jan. for my Motion for Gentic Testing of 4 yr old.

Re: Verbal abuse
Your question is can you get a Protective order for family abuse against this gentleman in Maryland even if the incident happened in Virginia.
All courts have jurisdiction over the safety of people who live within that territory. I do not know Maryland law but in VA you can get a proective order if you live here and the risk ofharm might come here even though incidents hapened somewhere else.
I would bring a protective order in VA when you go for paternity testing. The judge can do both at one time.
Good luck
