visitation .custody

My son lives with his mother who was just in A car collision and arrested for a DUI/DWI in Maryland(1st offense).Can I use this against her when I go to court for visitation/custody?

To properly address your inquiry I would like to know other facts that pertain to the care and support of your child. Her involvement/causing an automobile collision coupled with an arrest while intoxicated, without question, does not make her case stronger. Contact me to discuss.
