Visitation

I am separated from my wife and have been for a year and a half. I live in Maryland and she moved with my daughter to PA. I owe $4100 in back child support but $2400 of it is in lingo with the federal government from my federal return. I was out of work from November 2004 to March 2005 and it was hard to catch up with my child support. In the meantime my wife has not allowed me contact with my daughter. I have tried to call her numerous times, have sent cards and letters, and e-mails and I get no response. I feel like I am being pushed out as her father by my wife because she wants her boyfriend to be her father. My daughter is five years old and she needs her Dad. What can I do to see her and what do I do if my wife is keeping me from her?

After a year and a half, its time to file for a divorce. This will give you the opportunity to sue for the terms and conditions of custody and visitation. Given your financial circumstances, its time to change your child support agreement to something that will ensure you make payments.

Frankly you need to take legal action and should contact an attorney.

Visitation, or lack thereof, cannot be based upon nonpayment of child support. Your wife is wrong in this regard.

It appears that child support may have been established by the Office of Child Support and Enforcement. The obligation of this office is not to settle all matters between the parties.

Given the facts that you provide a modification of child support may apply. You may also file for an absolute divorce.
