Help w/ custody case
Mom only let me see the child right after birth (I was guest in her home for 2 wks) then served me for sole CC and CS back in May 07 (son was 2 mos). I didnt respond and had to get default order vacated. In Jan, master was disappointed I requested DNA test, gave me hard time cause I wasn't working, although I was in school FT. I just finished. Undergrad and work were too much so I quit in June 05 to focus on school. But it was mom who kept me from baby. I tried calling but no response, and when she did, she would deny me visitation. (Can I bring this up in court?) I countered for full custody and CS. Master issued temp CO. I see him EOW and pay CS. I am 35yo. I got PT work just after the CO but filed for modification of CS due to high bills and rent. I'm not a bad person, have no criminal history. I share apt w/ roomate and use roomates car to pick up baby (40 min away). I have no family here. Only here for son. Mom is angry, I'm not. Is it possible 4 me to get full or shared custody? What factors will court consider? I also pay CS for child in other state. Will this affect case? What is a merit hearing? Will court allow equal physical time w/ 1 yo at this age? Is each county diff? What else do u need 2 know. What can I do?

Given the child's age and the fact that he's been under the care of his mother since birth, plus the lack of real stability in your life, it's unlikely you will get custody, although you might be awarded joint legal custody. That would give you more input into important life decisions for the child. You can have continued visitation along the lines you have now. Each case turns on its own facts and the primary consideration is what is in the best interest of the child.
