my wife and I separated back in March 2012 after she kicked me out. She admitted to me since that she has slept with another man and has since moved in with him with her daughter (my stepdaughter) and our 9 year old son, abandoning our home and the bills that come with it. The divorce papers were served to her at her "new" address by a county sheriff. Is this legitimate proof of adultery in Maryland?

If she admits to it and is now living with him, that's pretty good evidence. In terms of the resolution of some of the financial issues that are part of the divorce, it would be significant if she admits to having engaged in the adulterous conduct while the two of you were still together as opposed to beginning it after. This is because one of the factors a judge must take into consideration in determining such things as alimony and distribution of marital assets is "circumstances leading to the breakup of the marriage".
