Will I get anything?

My stbx took all the equity out of our house (my name is not on the mortgage) after we separated. He has proceeded to hide/spend it all. He also has been recieving Md/state retirement/disability payments. Can I ask for his income or half of it in lieu of the equity that he would owe me if he proves to the court that he spent all of my half of the marital equity?

If your stbx wasted a marital asset and you can establish the amount, you would be entitled to a monetary award as part of a divorce proceeding. The problem may be collecting it. It sounds like the only real asset is the former marital home. If your name is on the title (albeit not on the mortgage), you could force a sale, but it wouldn't benefit you to do this until some equity is reestablished. If your name isn't on the deed, you won't be able to do this. Also, you can't attach his retirement/disability benefits. I assume he doesn't have another source of income, but if he did, you could attach that to satisfy a judgment entered by the court to enforce a monetary award.
