Legal Question in Family Law in Maryland

The other woman confesses

In trying to build a case of adultery against my husband I have

come upon a stroke of luck..maybe.. the other woman is no longer involved with him and is willing to corroborate my charges with certain stipulations. She does not want to testify in court, nor speak with an attorney via a deposition. Will it be legal if I type up the information and have her sign it? Would it hold more water in court if I have the 'testimony' taken by a third party such as the private investigator I have used? In either case she will agree to having a witness to the signing as well, either of her choosing or mine. I need to build as solid a case with this information with as little intimidation or involvement on her part as possible.

You will be unable to an adulterous relationship between this woman and your husband unless she's willing to testify under oath, either in a deposition or at a court hearing. A written statment signed by her may aid you in settlement negotiations over assets, alimony, etc. But a written statement isn't admissible in court because your husband has a right to cros-examine her, which obviously is impossible unless she testifies.
