Legal Question in Family Law in Maryland

one year separation leads to divorce

if you agree to a divorce after the year separation even though you are not truly the party wanting the divorce and would rather wait the two years....could you be hurt if you needed to go to court about alimony/child support in later years...would the court fault you for the one year separation divorce as being a willing participant and thus hurt your case for the future .....thanks

Re: one year separation leads to divorce

It's doubtful that the court would hold against you

the fact that you agreed to a one year divorce, but

if there are issues remaining to be worked out, I

would recommend waiting and trying to work them out

before the divorce agreement is finalized. The

court always likes it better if the two parties can

agree between themselves on issues such as alimony,

child support, property settlement, etc. If you have

not already done so, you should at least consult

an attorney briefly to make sure that there are

no rights you are signing away. I give a 1/2 hour initial

consultation at no cost and many others do the same. If

you at least go that far you will be in a much better

position to know what you are getting into.
