Of course, an employee can be terminated by her employer while on maternity leave. Whether or not she would have legal recourse against her employer in the event of such an unhappy occurence is another matter entirely and would depend largely upon the safeguards which were in

place to protect her at the time of her termination whether such were afforded by contract and/or statute such as the Family & Medical Leave Act(FMLA).
