I was in a domestic violence relationship. We have a child in common and I placed him in jail for 8 years. I do have legal custody of my daughter. How do I change her last name from his to mine?

You need to file a petition in the Circuit Court of the county of residence.
Publication in a newspaper may be required, and even if it is not, it is recommended. I recently answered a question on this matter and
there are further details in that response. I suggest you take a look at that response. If I recall correctly, I believe the answer was under the heading of "Name Change".
