Child Care / Liability

A friend of mine will be caring for as many as 6 children in her home for one week (only). Said friend has nothing more than a normal home owners policy. Would a Liability Release form be sufficient to protect her in case of an accident? If so, what kind of form and where can I find one?

Public policy in West Virginia would not allow a person to release liability for negligence in advance. That is why you do not have these documents floating around. It is possible to shift or allocate the liability risk by use of insurance. That is parties to a contract can require each other to have insurance and designate which coverage is primary. There are other methods of allocating risk. In all events, a parent could not contract away his or her child's rights. The parent could indemnify or waive or modify their own rights.
