Legal Question in Civil Litigation in Maryland

Condo issue

I'm a condo owner. and unknown to me, my roommates bathroom was leaking water from the faucet, which i guess damaged the wall on the condo of the person under my unit. I told the person yesterday that I was bringin someone to come look at it today. But when I called him back today, he said he already got an estimate on the job and had someone start fixing it already. Since he never gave me achance to fix it or even have a professional look it at the damage and try to fix it, am i responsible for the bill he gets from the person he claims to have brought to fix his unit? Because the price he quoted as his estimate was very unrealistic for the type of damage that was caused on his wall. Pls i need urgent help with this. Thank you.

You are not automatically responsible for this damage. Your responsibility is based on evidence of negligence on your part or on the part of your roommate. If the roommate knew of the leak and ignored it for any period of time, his/her failure to inform you or get it fixed could be the basis of making you responsible for this repair. If you maintain homeowners' insurance, contact your ins. company and see if you would be covered for this.

As far as the amount of the claim, assuming you're responsible, you would only be liable for the reasonable cost of the repair. If you refuse to pay and the neighbor sues you, you could bring in a repairman as a trial witness to testify as to what the job should have cost. On the other hand, the neighbor is entitled to have his own repairman do the job.
