Condo liability
I own a condo which is managed by a property management company. Over Presidents Day weekend we had some water leak into our property from the outside. The property mgmt company is responsible for the repairs, but no repairs have occured to this date. Multiple attempts to contact the manager had been unsuccessful, then about a month ago we received an email stating that she had opened a ticket, someone came out 3 weeks ago to make a list of damages but we still haven't heard from them about when repairs will take place. She is not answering her phone or returning calls. Condo fees are $272/mo. Unsure if mold has formed in the wall, there is large hole in the ceiling. I and my son suffer from asthma. Do we have grounds for a suit? I feel there are several issues - negligence, discrimination, and breech of contract - as they are responsible for repairs. Is this a legitimate claim?

It would be very difficult for you to establish that the delay of 2-3 months in repairing the problem has caused you physical injury. On the other hand, if the condo mgmt company is not performing their duties, you ought to try and engender support to have the condo board replace them. Of course, if the board is still under the developer's control, you will have to wait until the owners gain control.
