Court Ordered Payment Bounced

Hello,

I am the plaintiff and won a monetary judgement in civil court. The defendant did not pay. I then went to a hearing where the defendant wrote me a check for the full amount. The check bounced. I'm not sure where or what I have to file now. Could somebody please advise me as to what my next course of action should be? Thank you in advance for your thoughts.

First of all, I would check again with the debtor's bank to see if the check might have become good since it first bounced. It's possible he had deposited funds to cover the check which hadn't become available for payment when your check was presented. If not, you can fine a wage attachment against his employer if any. A form for this is available from the court clerk. And you can check periodically with the bank--they will usually tell you if the check you have would be good if cashed at any given time.

You will need to take steps to collect on the judgment, either by garnishment, or by attachment of assets. I would be able to locate assets and the defendant if necessary using our databases.
