Legal Question in Civil Litigation in Maryland

From criminal case to civil suit!

I was the defendant in a criminal case filed by a major retail chain for theft. I was convicted and incarcerated for 36 days. Now the county States Attorney is considering overturning the conviction do to facts recognized in the transcripts. He is considering filing obstruction of justice charges against the retail companies loss prevention employees for influencing testimony of the witnessess. It is now my desire to seek damages against the retail chain. Yet the statute of limitation is coming up! What do I do?
