Legal Question in Civil Litigation in Maryland

Garnishment of Property other than wages

A creditor issued a writ of garnishment on my bank account. I filed a motion to elect an exemption pursuant to Maryland Rule 3-643d. According to Maryland Code 11-504b5, cash or property up to $6000 in value is exempt from execution. When I filed the motion, the judge requested a hearing. Is there any reason that the judge would not grant my request?

Unless there is some issue as to whether your motion was timely (within 30 days of the attachment), you should be entitled to the exemption.
