Legal Question in Civil Litigation in Maryland

Good afternoon. I bought a truck from a "friend" and the transmission went bad the next day. They took the car back and was supposed to get it fixed but have been giving me the run around for nine weeks now. I have text messages and emails where I have been asking about the status og the car. Can i sue them and do I need a lawyer? Should I take back possession of the truck even though they have not fixed it?

If you paid less than $5000 you can sue them in small claims court. If it was more than that, you will probably need a lawyer, although you aren't required to have one. The fact that your "friend" offered to fix it demonstrates that there were previous transmission problems he knew about. Go to the civil clerk at the District Court of Maryland in your county and ask for a complaint form that you can fill out, or you can access one from the court website. You'll have to file it there and then serve it on your friend using a process server or certified mail. Chances are he won't show up for the hearing if he's served, and you will get a judgment, but then the harder part will be collecting.
