If you are the plaintiff wanting out, you file a line asking the court to dismiss your complaint. If you are a defendant, you file a motion to dismiss or a motion for summary judgment. There are legal bases for these motions which you can learn about by consulting with an attorney who is knowledgeable about litigation.
