Liability on Auto Damages

My son Charlie allowed his son Dan to drive his car around a baseball field while my son Charlie was lining the fields for a baseball game. Dan drogve Charlie's car into a ditch and did over $3600 worth of damage to the car. He had Charlie's permission to drive the car. Is Dan legally liable to bear any of the repair costs to the car or perhaps the deductible? There are two witnesses that Dan did the damage, not Charlie.

Yes, Dan is liable because he was negligent in operating Charlie's car. If you have collision coverage on the car, you can collect from them less the deductible. Your insurer will then go after Dan, and try to recover the entire cost of the repair including your deductible. Or Dan can simply pay for the repair directly and you don't have to involve your insurance.
