Legal Question in Civil Litigation in Maryland
Loaning Money
In August of 2007 I lent someone close to $9000. so their house would not get forclosed. I did this with the understanding that the money would be paid back to me. To date, I have not received any payments from this person. I didn't have a contract or anything, which I now realize was a mistake. Any chance of recouping some/all of that money? If so, what steps do I need to take to start the process? I am a resident of Harford County, MD

Re: Loaning Money
You would need to file a suit against your borrower and try to collect through a bank account attachment or a wage garnishment if they are employed. The suit would be filed in the District Court of MD in the county where the borrower lives or works. I hope you were at least smart enough to give him/her a check so you have proof of payment. Otherwise it will be your word against theirs, although if you sue they probably won't even defend. Of course, they can declare bankruptcy and that will probably prevent you from collecting anyway.
