Legal Question in Civil Litigation in Maryland

Who has to pay tree removal fees

Fifteen years ago I planted some pine trees on an easement along my driveway. The property belonged to another home owner. The easement is intended for ''ingress, egress, and normal driveway purposes. I asked the homeowner at the time if it would be okay to put the trees there. They agreed. Twelve years later, they moved out, but the trees remained. The new owner decided to cut them down and remove the stumps and is now suing me to pay the costs, even though the trees were on the property when they bought it. Can they do this?

An easement to facilitate transportation does not necessarily include trees to buffer against the use; however, this is a matter of your local zoning. The current owner assummed the land in its current state and the only way that you could be liable is if the past owner provided some right. You should defend against this suit.
