private residence next to school - damaged by school activity

We have owned a residence (a city rowhouse) across an alleyway from a large urban school.

The constant loading dock & trash removal activities (occurring within 10 feet of our home) have caused serious structural damage to our home (as well as creating a very unpleasant living environment within our home).

What legal recourse is available to attempt to recover compensation for our damages?

This is a matter that would be difficult to resolve through court action. Obviously the school must perform normal maintenance functions such as trash removal. If you could demonstrate that there are alternative methods of doing this that would lessen the impact on your property, you should try and start a dialogue with the authorities to see if they could adopt such methods. To pursue court action, you would need to hire experts who can attest to the effects on your property from these activities, and who could describe less intrusive methods that the school could use to conduct these functions.
