Legal Question in Civil Litigation in Maryland
I received an alcohol citation in Howard County Maryland last week. It was my first citation in Md. I had received one 2 years piror in vermont and went trhough diverson and so it is now off my record. I have a court date in Md and I was wondering will this count as my first or second citation. Also I will have turned 21 by the time of my court date will that help at all?

The VT case probably isn't on your record because in all likelihood any conviction was struck or never entered upon successful completion of diversion. However, if you plead guilty in Howard County, before sentencing the judge may ask if you have any other similar violations, and you will probably be under oath to tell the truth. Your turning 21 is significant only that you are now of age, it certainly doesn't mitigate the violation.
